Terms of service

These Terms of Service cover every visit to this website and every purchase from it. "KATE GRANA", "we", "us" and "our" mean the KATE GRANA store, which is a series of NextCTR LLC. The store is built on Shopify, the ecommerce platform that provides the tools we sell through. By using the site or buying from us you are agreeing to these Terms and to our Privacy Policy; if you would rather not be bound by them, please do not use the site or place an order.

1. Who can shop here, and what we need from you

You need to be at least the age of majority where you live. When you order or open an account we may ask for an email address and billing, payment and shipping details; you promise those details are accurate, current and complete, and you keep any password to yourself. The site is for lawful use only. Off limits, in particular: (a) trampling on our intellectual property rights or anyone else's, (b) giving us information that is false or misleading, (c) sending viruses or any other harmful code, (d) harvesting other people's personal information, and (e) anything that stops or hampers someone else's use of our services.

2. Products, prices and mistakes

We do our best to show each piece truthfully in photographs and descriptions, but every screen renders colour a little differently and we cannot promise the shade you see on your device is exact. We may restrict the sale of any product to any person or place, and we may withdraw a product whenever we choose, without notice. Prices can change without notice, and unless we say otherwise they exclude state and local taxes. Sometimes a listing, price, promotion or stock level carries a typo, an inaccuracy or an omission; where that happens we may correct it, update the information or cancel an order at any time, without prior notice.

3. Placing an order

An order you place is an offer to buy, and KATE GRANA may accept, limit or refuse it for any reason. When you pay, you confirm you are entitled to use the payment method you choose and that your card issuer or bank will honor the charge. Orders move quickly, so the window for changing or cancelling one is short: normally within 2 hours of ordering. Once an order has been processed, our Refund and Return Policy takes over.

4. Getting it to you

Carriers run late, weather turns, and some processing sits outside our hands; we are not liable for delays of that kind, and every delivery date we give is an estimate. While a parcel is in transit it remains our responsibility. Should it go missing before delivery, or reach you damaged, write to support@kategrana.com: we raise an inquiry with the carrier, and as soon as the loss or damage is confirmed we arrange a replacement or a refund, in the way our Shipping Policy describes. Damage and defect claims must reach us within 7 days of delivery, as our Refund and Return Policy describes. Once the carrier records a parcel as Delivered at the checkout address, risk of loss passes to you, and KATE GRANA is not liable for a loss or theft after that point. If the address you entered was wrong or incomplete and the delivery fails, see Failed deliveries in our Shipping Policy; a reshipping fee may apply.

5. What belongs to us

The KATE GRANA name and everything on the site, from the words and photographs to the graphics, logos and the way the pages are put together, belongs to us or to our licensors and is protected by copyright and other intellectual property law. Please do not copy, reproduce, sell or otherwise exploit any of it without our written permission.

6. Other companies you will meet here

The site may carry material from, or links to, third parties that have nothing to do with KATE GRANA; we do not monitor them and are not liable for any harm or loss connected with goods, services or resources found through them. Our store is hosted by Shopify Inc.: Shopify supplies the infrastructure, but your purchase is a contract between you and KATE GRANA, and Shopify is not a party to that sale and is not responsible for any claim about the products you buy. Because the store runs on Shopify, Shopify also processes information in order to provide these services; how personal information is handled is described in our Privacy Policy, and using the site means you acknowledge those practices.

7. If you send us ideas

Should you send us suggestions, feedback, reviews or proposals, whether online, by email or any other way, you agree that we may edit, copy, publish and use them in any medium, at any time and without restriction, and that we owe you no confidentiality and no payment for them.

8. What we do not promise, and where liability stops

The site, and the services behind it, are provided "as is" and "as available". There is no promise that the site will always be available, on time, secure or free from errors. This applies to the website and its services only: it does not apply to the products you buy from us. Whatever rights consumer protection law gives you, including any implied warranty the law does not allow us to exclude, stay exactly as they are, and how we deal with faulty, damaged or incorrect items is the subject of our Refund and Return Policy. Beyond that, and only as far as the law permits, neither KATE GRANA nor our directors, officers, employees or suppliers is liable for indirect, incidental, special or consequential damages that flow from your use of the website or its services.

9. Indemnity

If a third party brings a claim or demand against KATE GRANA or NextCTR LLC, or against our subsidiaries, partners, officers, directors, agents, contractors or employees, because you broke these Terms, broke the law, or infringed someone's rights, you agree to indemnify, defend and hold us harmless, reasonable attorneys' fees included.

10. Disagreements

This part affects your legal rights, so please read it closely. If a dispute, claim or controversy comes out of these Terms or out of a purchase of KATE GRANA products, it goes to binding arbitration on an individual basis, not to court, and by using our services you accept that. Both you and KATE GRANA give up any right to a jury trial, and any right to bring or join a class action, class arbitration or representative proceeding. The American Arbitration Association (AAA) administers the arbitration under its own rules, and the laws of the State of Texas govern it. Should any provision of these Terms prove unlawful, void or unenforceable, it still applies as far as the law permits, the unenforceable part is treated as severed, and the rest of these Terms stands.

11. Governing law and updates

These Terms, and any separate agreement under which we provide services to you, are governed by and interpreted under the laws of the State of Texas, United States. We may update, change or replace any part of these Terms at our discretion by posting the new version here; please look back from time to time, because continuing to use the site after a change is posted means you accept the change.
